North Carolina General Statute 95-129(1) section 5(a)(1) of the
Occupational Safety and Health
Act of North Carolina:  The employer did not furnish to each of his
employees conditions of
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to hazards associated with working in a hot environment:
a)sawmill facility - The employer did not train employees, who were
exposed to a
heat index of 107 degrees F, to recognize and avoid the hazards associated
with
working in a hot environment and did not provide adequate facilities for
employees to hydrate and cool themselves; on August 01, 2006, an employee
lost
consciousness and died after exhibiting symptoms of heat stress, including
but not
limited to, nausea, sweating, disorientation, and staggering gait.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS
TO CORRECT THIS HAZARD INCLUDE, BUT ARE NOT LIMITED TO, DEVELOPING
AND IMPLEMENTING SPECIFIC WORK/REST CYCLES, TRAINING EMPLOYEES ON
THE SIGNS AND SYMPTOMS OF HEAT STRESS, FACTORS THAT AFFECT A
PERSON'S RISK, PREVENTION, AND EMERGENCY PROCEDURES, AND ENSURING
THAT EMPLOYEES ARE PROPERLY ACCLIMATIZED TO THE WORK ENVIRONMENT.
