Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to the hazard of being struck by
a falling load from an overloaded
crane:
a)Fabrication area, outside of the machine shop - a portable bottom
running jib crane had not
been load tested prior to initial use.
Reference:  ANSI B30.11-1980; paragraph 11-2.2.2(a) Rated Load Test -
Prior to initial use,
all the equipment mentioned in the above paragraph is to be tested.
NOTE:  Among other methods, one feasible and acceptable abatement method
to correct this
hazard is to load test all cranes as per ANSI B30.11-1980.
b)Fabrication area, outside of the machine shop - there were no load test
reports available for the
portable bottom running jib crane.
Reference:  ANSI B 30.11-1980; paragraph 11-2.2.2(a) - Test reports shall
be placed on file.
NOTE:  Among other methods, one feasible and acceptable abatement method
to correct this
hazard is to conduct the load testing initially and annually, and have the
test reports readily
available.
