Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards: a) Facility, Aluminum area Employees were engaged in open burning of debris inside of the building, including but not limited to wood, paper, and cardboard. Violation observed on or about 12/28/2005. Among other methods, one feasible means of abatement is to follow the regulations set forth in the New Jersey Uniform Fire Code / State Fire Prevention Code F-403.1, which states; A person shall not cause or allow open burning unless approved in accordance with this code.
