Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to injury from falls and/or equipment failure:
(a)  For the employee working from a makeshift work platform that was
attached to the
top of a scissor lift and supported by the guardrail system of the lift,
located at 1831
NDSU Park Research Drive, Fargo, North Dakota.
Abatement Note:  Among other methods, one feasible and acceptable means of
abatement
to correct the hazard would be to comply with American National Standards
Institute,
ANSI A92.6-1990 American National Standard for Self-Propelled Elevating
Work
Platforms, Section 7.11.1 which states, "Personnel shall maintain a firm
footing on the
platform while working thereon.  Use of planks, ladders, or any other
device
on the
aerial platform for achieving additional height or reach shall be
prohibited."
