Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling to the ground while in a platform mounted on the forks of a forklift that was not properly used and/or secured: (a) Location - Warehouse floor: On or about 1/27/06, employees were riding the forks in a cage that was not properly installed and/or secured. Among other methods, one feasible and acceptable means of abatement is to follow the recommendations of American Society of Mechanical Engineers (ASME) B56.1-1993, which includes but is not limited to, means to securely attach the platform to the lifting carriage or forks, and to prevent the lifting carriage or forks from pivoting upward, and a platform width not greater than the overall width of the truck plus 10 inches on either side.r
