Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about January 20, 2006, an employee riding the front end of a Skid Steer loader as access from the third level to the second level, exposed to fall and crushed-by hazards. Among other methods, one feasible means of abatement would be to follow the manufacturer guidelines for safe operations of the earth moving equipment.
