Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On or about 16 February 2006, employees working at FM 564, Mineola Texas were exposed to struck-by hazards associated with the nearby operation of the Caterpillar 322 Tracked Hydraulic Excavator in that the operator's view is obstructed by the boom, hydraulic cylinders, and engine housing. Among other methods, feasible means of abatement include but are not limited to operating the excavator in accordance with the direction provided in the Operation & Maintenance Manual provided by the manufacturer, Safety chapter. Additionally the use of a dedicated ground guide to insure that no persons walk into the swing arc or blind side of the track Hoe.k
