Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about September 13, 2006, at a work place located between 4127 and 4213 Main St., Rowlett, TX, the employer by not redirecting west bound traffic around the work area, exposed at least four employees, who were walking and working in the open lane, were exposed to the hazard of being struck-by a motor vehicle. Among other methods, one feasible means of abatement includes but is not limited to: Complying with Section 6C.05, Transition Area, of the Manual on Uniform Traffic Control Devices, Millennium Addition, December 2000.
