Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about January 8, 2008, at a work site located at the Dallas Market Center located 2100 Stemmons Freeway in Dallas, Texas 75207, at least one employee, working to repair an awning, was exposed to the hazard of falling while working from the top step of a step ladder. Among other methods, one feasible means of abatement includes but is not limited to: Complying with the Manufactures Technical Manual on Fiberglass Ladders.
