Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by moving container: a.Truck Number M-77 - The wire rope was not being inspected on a daily basis. b.Truck Number M-77 - The wedge in the becket had been damaged by prior use, and the surface was no longer smooth. The roughened surface could damage the wire rope. c.Truck Number M-77 - A load was caught in the container on the truck, and attempts were made to dislodge it by rapidly moving the truck forward and backward and stopping abruptly. d.Truck Number M-77 - A load was caught in the container on the truck, and attempts were made to dislodge it by rapidly moving the hydraulics up and down. e.Site - Truck operators had not reviewed the Operation and Service Manual for the Benlee trucks. f.Site - Truck drivers, operators and mechanics had not been properly trained regarding inspection procedures of the Benlee trucks and components. Among other methods, one feasible and acceptable means of abatement would be to comply with the guidelines and limitations provided in follow the information provided by the equipment manufacturer in their Operation & Service Manual.
