Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed in the event of an upset or overturn of a forklift: a.The employer did not ensure that each powered industrial truck operator was protected from the hazard of being crushed in the event of an upset or overturn of a forklift by utilizing a restraint system. This violation was noted on December 06, 2007 at a worksite located at 11 Industrial Dr., Londonderry, New Hampshire, with regard to the Clark C300 industrial truck (S/N 356 162 5146) which was not equipped with seatbelts. To abate this violation, the employer must ensure that all operators use restraining equipment and, where the equipment was not originally provided on the vehicle, to retrofit the old industrial trucks with operator restraint equipment. Retrofit kits for this model of truck have been available since 1983.
