Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to burns, crushing, and engulfment hazards from hot asphalt:
69 Alleghany Street, Boston, MA:  On or about June 29, 2006, the employer
did not ensure
employees were protected from exposure to burns, crushing, and engulfment
hazards from hot
asphalt due to removed slurry locks and defective air locks on the
tailgate of a Western Star
dump truck.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to:
1)maintain and inspect dump trucks prior to driving the truck and prior to
releasing and
unloading asphalt, and
2)provide employees training on performing truck inspections and on
releasing and
unloading asphalt.g
