Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, an employee was
exposed to fall and crushing hazards from the tip over of a scissor lift
platform on an uneven
surface without outriggers.
Location - 315 C Street, Boston, MA:
On or about 6/29/06, an employee on the scizzor lift was seriously
injuried when the
JLG scissor lift tipped over as the employee was raising the platform of
the lift on an
uneven surface, 3.5 degree side slope, beyond the safe height without
outriggers.
One feasible and acceptable abatement method, among other methods,
consists of the
following steps:
1)  Provide training to employees per manufacturer's recommendation,
2)  Perform pre-delivery operational checks on an even surface, and
3)  Raise the lift platform using the ground control station.
