5(a)(1):of the Occupational Safety & Health Act of 1970: The Employer did not furnish a place of employment free from recognized hazards that were causing or likely to cause death or serious physical injury, in that employees were exposed to fall hazards by positioning the platform of a scissors lift, in a way that was not flush with the access door through which furniture was to be loaded on the platform, which resulted in unguarded gaps through which employees could fall the loading process. Inside Garage, Storage Loft The employees were exposed to a fall of 13-feet to the concrete floor below while moving furniture through an unguarded door opening without proper fall protection.
