Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed fall hazards while standing on the forks of a forklift
without fall protection while
being elevated:
Warehouse:  Employees were exposed to a fall hazard of up to 24 feet when
they were elevated
by a forklift while standing on the forks in order to access the second
and third tiers of the
shelving units to perform duties such as, but not limited to, moving
pallets that are stuck on the
gravity feed and retrieving boxes that may have fallen off the pallets.
Among other methods, one feasible and acceptable method to correct this
hazard would be to:
1)  Ensure that a platform for elevating personnel meeting the
requirements
in ASME/ANSI
B56.1-2000, "Safety Standard for Low Lift and High Lift Trucks" is readily
available whenever
employees may have to access the upper shelving tiers; 2)  Monitor
employees to ensure
compliance;  3)  Enforce company policy and requirements in ANSI/ASME
B56.1-2000 for the
use of an approved work platform when elevating employees with a forklift.
