Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards associated with climbing vertical frame members of the racks to gain access to the shelving when storing and/or retrieving stock: At the site in the walk-in freezer: Employees are exposed to serious injury while climbing the storage racks when storing/retrieving stock. An employee suffered fatal injuries when he fell while climbing the rack. One method, among other methods to correct the condition, is to implement a documented training program that would establish work rules and a way to enforce those work rules.
