Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)Maintenance Department, Hoist - On or about 02/02/06, the hook on the overhead hoist had a damaged safety latch and did not close properly. Among other methods, one feasible and acceptable method to correct this hazard would be the installation of a proper safety latch on the hook as recognized in the American Society of Mechanical Engineers Standard ASME B30.16-1993, Overhead Hoists, Section 16-1.2.9 Hooks.
