Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to hydrogen sulfide, combustible gases, and oxygen
deficiency:
On or about May 8, 2008, and at times prior there to, at a workplace
located at 3904 Towne
Crossing Blvd., Mesquite, TX; employees entered into a crawl space, to
repair a sewage
pipe leak, without assuring acceptable atmospheric conditions for all
periods of entry;
providing appropriate respiratory equipment in the event of an emergency,
and assuring a
common communication system for monitoring the need for emergency rescue.
Among other
methods, a recognized and feasible means of abatement to correct this
hazard includes, but is
not limited to: a) Full implementation of the elements required by the
American National
Standards Institute (ANSI) Standard Z117.1 (Safety Requirements for
Confined Space).
