KRS 338.031(1)(a): Every employer did not furnish to his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: a.The employer failed to adequately protect one employee from the hazards of being crushed by the loaders bucket and/or being ejected from the cab of two Bobcat skid loaders by removing the manufacturers safety devices, which include the lap bar and interlocked safeties, at the stockyard site located at 375 Lisle Industrial Dr. in Lexington, Kentucky. One feasible and acceptable abatement method, among others, to correct this hazard is to replace the mechanical and electrical safety devices removed by the employer.
