KRS 338.031(1)(a): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to: The hazard of being struck by gypsum ceiling tile which has been falling from above the Line One Bottle Filler also known as the CIP line on the east side of the Plant. One feasible and acceptable abatement method would be to fix the leaking pipe which is causing the ceiling tiles to fall.
