KRS 338.031(1)(a): Each employer did not furnish to each of his employees
employment and
a place of employment which were free from recognized hazards that were
causing or were
likely to cause death or serious physical harm to his employees:
a.On or about May 18, 2006, the employer did not ensure that 26 employees
were not potentially exposed to a hazard of driving defective material
hauling
equipment due to the lack of enforcement of the companys required
inspection/repair procedures.  The procedures required the signatures of
drivers and mechanics at times that the inspection report was submitted to
maintenance and upon completion of the vehicles being fixed.  One feasible
and acceptable abatement method, among others, to correct the hazard is to
have management, drivers and mechanics to follow the companys
inspection/repair report procedures and that all required documentation is
properly completed to ensure that all defects are corrected on equipment
before
being operated by employees.
