Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Pre-cast concrete plank collapse. a) 66 Main Street Yonkers, New York (3rd Floor): Employees were exposed to the hazard of a pre-cast concrete floor collapse in that the employer failed to follow J.P. Carrara & Son's Inc, (manufacturer and distributor of the pre-cast concrete planks) shop drawings which require the pre-cast planks to have a minimum bearing of three inches (3") (+/- 3/4") as per minimum tolerances noted in the PCI Precast/Prestressed Concrete Institute Erectors Manual. b) 66 Main Street Yonkers, New York (4th Floor): Employees were exposed to the hazard of a pre-cast concrete floor collapse in that the employer failed to follow J.P. Carrara & Son's Inc, (manufacturer and distributor of the pre-cast concrete planks) shop drawings which require the pre-cast planks to have a minimum bearing of three inches (3") (+/- 3/4") as per minimum tolerances noted in the PCI Precast/Prestressed Concrete Institute Erectors Manual. c) 66 Main Street Yonkers, New York (5th Floor): Employees were exposed to the hazard of a pre-cast concrete floor collapse in that the employer failed to follow J.P. Carrara & Son's Inc, (manufacturer and distributor of the pre-cast concrete planks) shop drawings which require the pre-cast planks to have a minimum bearing of three inches (3") (+/- 3/4") as per minimum tolerances noted in the PCI Precast/Prestressed Concrete Institute Erectors Manual. d) 66 Main Street Yonkers, New York (6th Floor): Employees were exposed to the hazard of a pre-cast concrete floor collapse in that the employer failed to follow J.P. Carrara & Son's Inc, (manufacturer and distributor of the pre-cast concrete planks) shop drawings which require the pre-cast planks to have a minimum bearing of three inches (3") (+/- 3/4") as per minimum tolerances noted in the PCI Precast/Prestressed Concrete Institute Erectors Manual. e) 66 Main Street Yonkers, New York ( 7th Floor): Employees were exposed to the hazard of a pre-cast concrete floor collapse in that the employer failed to follow J.P. Carrara & Son's Inc, (manufacturer and distributor of the pre-cast concrete planks) shop drawings which require the pre-cast planks to have a minimum bearing of three inches (3") (+/- 3/4") as per minimum tolerances noted in the PCI Precast/Prestressed Concrete Institute Erectors Manual. f) 66 Main Street Yonkers, New York ( 8th Floor): Employees were exposed to the hazard of a pre-cast concrete floor collapse in that the employer failed to follow J.P. Carrara & Son's Inc, (manufacturer and distributor of the pre-cast concrete planks) shop drawings which require the pre-cast planks to have a minimum bearing of three inches (3") (+/- 3/4") as per minimum tolerances noted in the PCI Precast/Prestressed Concrete Institute Erectors Manual. g) 66 Main Street Yonkers, New York ( 9th Floor): Employees were exposed to the hazard of a pre-cast concrete floor collapse in that the employer failed to follow J.P. Carrara & Son's Inc, (manufacturer and distributor of the pre-cast concrete planks) shop drawings which require the pre-cast planks to have a minimum bearing of three inches (3") (+/- 3/4") as per minimum tolerances noted in the PCI Precast/Prestressed Concrete Institute Erectors Manual. Among other methods, one feasible and acceptable method(s) to correct this hazard is: 1.Follow J.P. Carrara & Son's Inc, (manufacturer and distributor of the pre-cast concrete planks) shop drawings which require the pre-cast planks to have a minimum bearing of three inches (3") (+/- 3/4") as per minimum tolerances noted in the PCI Precast/Prestressed Concrete Institute Erectors Manual. 2.5.3.2(b) NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
