Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards, while operating a rough terrain forklift without wearing a seatbelt: On or about 02/01/06 at Greensboro, GA: An employee was exposed to struck by hazards, while operating a rough terrain forklift without wearing a seatbelt. " AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS" 1. Instruct each employee on the wearing of seatbelts, while operating powered industrial trucks and enforce a policy to ensure compliance. This requirement is referenced in the JCB operator's manual. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
