Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards encountered in the laboratory during the research utilizing Neisseria Meningitides. The hazards were the following: a) An employee was utilizing a 16 ml glass test tubes containing inactivated Neisseria Meningitides (Nm), chloroform, and radio isotope Phosphorous-32 (P-32) on the Eppendorf Refrigerated Multipurpose Centrifuge 5810 R. While centrifuging the 16 ml test tube, the glass test tube broke spilling its contents. Safety caps were not available. The test tube utilized was incompatible with centrifuge manufacturer's recommendations; c) Instructions and training of the specific practices and techniques of each laboratory to ensure safety, and the procedures for dealing with accidents at each laboratory were not given to the laboratory staff, on or about 12/01/05. Among other methods, one feasible and acceptable abatement method to correct these hazards are to: 1. Use the proper tube and/or the proper centrifuge to prevent breakage of the tubes. 2. Follow the National Institute of Health (NIH) Guidelines for Research Involving Recombinant DNA, Section IV-B-7-d-(1) through e-(4). In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
