Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or about May 31, 2006 at 888 Harvest Brook Dr. in Lawrenceville, GA the
employer did
not take preventive measures to keep bystanders away from the work area
while the skid steer
loader was in operation lifting dirt and cutting the drive way, as
required by NIOSH Alert
"Preventing Injuries and Deaths from Skid Steer Loaders", February 1998,
DHHS (NIOSH)
Publication No. 98-117, and the New Holland Construction LS180 Operator's
Manual. Among
other methods, one feasible and acceptable method is to train heavy
equipment operators to
visually check the area for bystanders and other employees before
operating machinery, and to
guard/shield the area to prevent access.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
