Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: roll over/struck by/crush injury resulting from the
failure to use a forklift
restraining system (seat belt) which is required per the manufacturer's
recommendation and per
ANSI B56.1-1969.
On or about June 27, 2006, CSHO observed employees operating the Clark and
Daewoo forklift
without the use of a forklift restraining system (seat belt).
A feasible and acceptable method in correcting this problem would be to
have a forklift
certification training program, ensure that employees are trained and
enforce the use of seat belts
as required by ANSI B56.1 for power industrial trucks.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for
this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
