Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falls from heights.
Date: March 29, 2007
Location: 120 Anderson Ave., Canton, Georgia.
Equipment: Rough Terrain Forklift, Job-made basket, and extension ladder.
Conditions: Employees were installing siding at elevations of
approximately 50 feet while
working from a ladder supported by a job-made basket attached to the forks
of a rough terrain
forklift.(ASME B56.6-1992 Section 5.15.1 (a),(b),(k),(m),(s), and (u))
Among other methods, one feasible and acceptable means of abatement to
correct this hazard
is to: Make use of the  appropriate aerial lift equipment that can reach
the required heights, and
that is also equipped with a man basket with hard points/tie-off position,
body harness and
lanyards to ensure the employee(s) remain in the basket during siding
operations.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
