General-duty citation text

T.C.A. 50-3-105(1):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were likely to cause death or
serious physical
harm to an employee, in that a Welder/Painter was exposed to the hazard of
a falling
(approximately 500 pound) steel car dolly when working underneath it on
5/31/06.  The
dolly was suspended about 6 feet in the air by the hydraulic lift arms of
a forklift, with no
stand to prohibit falling of the arms and dolly should the lift hydraulics
fail.
The employer recognized the potential hazard, and it was recognizable by
common sense.  If
the lift arms failed and the dolly fell (or if it fell for any other
reason - and it was observed
wobbling) when the employee was underneath, serious physical harm to the
employee was
likely.  The employee was cleaning and taping the bottom of the dolly.
Among other methods, one feasible and acceptable abatement method for
correcting this
hazard is to set the car dolly on stable stands, so that the dolly would
be held up without the
necessity of the forklift arms.
