employer did not furnish to each of his employees conditions of employment
and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees:
a) Facility, Centrifuge Room -Dayton 1 Ton Hoist had not been load tested.

(1)New hoists shall be load tested by the manufacturer as specified in
para. 16-2.2.1(a)(1)
with a test load of not less than 125of the rated load, except that  if
load testing of
the hoist cannot be performed by the manufacturer, the user shall be
notified  and the
load test shall be accomplished at another location or job site, by or
under the direction
of a designated person prior to the hoist being placed in service.
NOTE:Among other methods, one feasible and acceptable method to correct
this hazard is to load test the
underhung hoist and maintain a record of that load test.
