North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee was exposed to a fall hazard: a)jobsite, for the employees working from the JLG scissor lift, employees were sitting on the top rail and/or standing outside of the guard rail system on the lift, exposing employees to 7 foot fall onto a concrete floor hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees maintain firm footing on the floor of the scissor lift platform. Reference: ANSI/SIA A92.6-1999, Section 8.10(9).
