Labor and Employment Article, Section 5-104(a): The employer did not
furnish employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees:
(a)Date of Violation:12/15/05
Location:MD Route 198 and Russet Green West
Condition:A work zone for a crew of landscaping workers was not marked
with a
traffic cone taper, and traffic cones were not placed around each work
vehicle that was parked on the asphalt shoulder, and advance traffic
warning signs warning "MEDIAN WORK AHEAD", and "LEFT
SHOULDER CLOSED AHEAD" were not placed 100 feet, and 200 feet
in advance of the work zone.  In lieu of the channelization devices,
rotating amber warning lights, or strobe lights were not installed and used
on either truck in the work zone.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to place advance traffic warning signs warning "MEDIAN WORK AHEAD", and
"LEFT
SHOULDER CLOSED AHEAD" 100 feet and 200 feet in advance of work zone, as
well
as
placing a traffic cone taper on the shoulder, and around the parked
vehicle(s) to divert vehicular
traffic away from the closed shoulder and work area.  In lieu of the
channelization devices,
rotating, amber lights, or strobe lights, can be installed, and used on
either truck in the work
zone.
Abatement documentation (photographs, receipts, copies of programs,
training
certification, etc.) is required for this item.
