North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina: The
employer did not furnish to each of his employees conditions and a place
of employment which were free from
reconized hazards that were causing or likely to cause death or serious
physical harm to employees:
a) Facility - A rated load test, with written certification, had not been
conducted on the CM 1/4 ton
hoist in the column area.

Tests
(b)Electric Powered or Air Powered Hoists
(1)Complete new hoists shall be dynamically load tested by the
manufacturer as specified in paragraphs 16-2.2.1(b)(1) and (2) with a
load test not less than 125of the rated load, except that if testing
cannot be performed by the manufacturer, the user shall be notified and
the load test shall be accomplished at another location or job site, by or
under the direction of a designated person prior to the hoist being placed
into service.(The user is testing the complete structure whether or not
the hoist was tested by the manufacturer.)
(c)The person conducting the load test shall prepare a written report of
the load
sustained during the test and the operations performed during the test.
Reports
must be placed on file.
Note: Among other methods, one feasible and acceptable method to correct
this hazard is to load test
the underhung hoist as required and maintain a record of the load test.

Inspection Classification.
(a)Prior to initial use, all new, altered, modified hoists shall be
inspected by a
designated person to ensure compliance with this standard.
(b)Inspection Intervals. Inspection procedures for hoists in regular
service is
divided into two general classifications based upon the intervals at which
inspections should be performed:
(1) Frequent Inspections
(2)Periodic Inspections
Note:Among other methods, one feasible and acceptable method to correct
this hazard is to conduct
hoist inspections as required.

ton hoist, in the column area,
had not been load tested as required.

Operational Tests. Prior to initial use, all new, altered, modified, or
repaired lifting
devices shall be tested to ensure compliance with this standard, including
the following
functions:
(a)Moving parts. Lifters with moving parts shall be tested to determine
that the
lifter operates in accordance with the manufacturer's instructions.
NOTE:  Among other methods, one feasible and acceptable method to correct
this hazard is to properly
load test the under the hook lifting device as required.
