Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling:
(a)  At the Ivers Apartment Building located at 324 Robert Street, Fargo,
ND, where a
worker was cleaning the sixth floor hallway and entered the fire escape to
take a break
from work.  The worker fell over the fifth floor landing railing that was
approximately
35 inches high.
Abatement Note:  Among other methods, a feasible and acceptable abatement
to correct
this hazard would be to ensure that employees performing cleaning services
in apartment
buildings do not enter fire escape landings that are not equipped with
appropriate fall
protection.
