North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to struck by hazards:
a)The Overlook neighborhood construction site, employee
operated a Bobcat 873 Skid-Steer loader while using an
unapproved attachment (by the manufacturer) which was not
attached to the loader to prevent it from falling.
Among other methods, one feasible and acceptable
abatement method to correct this hazard is to follow the
manufacturer's instructions and recommendations to use
approved attachments as specified in the Operation and
Maintenance Manual for Model #873.
