North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by/contact hazards from materials falling from underhung hoists. a)facility, employees utilized Yale trolley hoists that were not maintained in accordance with good engineering practices. 1)Frequent and/or periodic inspections were not conducted on the hoist, the hoist chain, and hook. 2)Safety latch on hoist hook near vertical cut-off saw was damaged that prevented the ability of the latch to bridge the throat opening of the hook. 3)Safety latch on the hoist hook near the Carol Jamison 16 inch lathe was missing. Feasible and acceptable abatement methods to correct this hazard includes, but is not limited to: 1.Inspect and maintain hoist in accordance with manufactures requirements and American National Standards Institute (ANSI) B30.16-2003, Overhead Hoist (Underhung). a.All new, altered, or modified hoist shall be inspected by a designated person to verify compliance with the standard. (Reference ANSI 30.16- 2.1.1, Inspection Classification) b.Hooks shall be equipped with latches unless use of the latch creates a hazardous condition. When required, a latch shall be provided to bridge the throat opening of the hook, and retain, under slack conditions, such items as, but not limited to, slings and chains. (Reference ANSI 30- 16.1.2.9, Hooks)
