Section 5(a)(1) of the Occupation Safety and Health Act 0f 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:  amputation injuries from the lack of the development and
implementation of specfic
"safe distance" safeguarding procedures when operating a mechanical press
brake.  Among other
methods, one feasible and acceptable abatement method to correct this
hazard is to establish and
enforce the safeguarding procedures stipulated in ANSI B11.3-1982 and OSHA
Instruction CPL-
02-01-025.  Essential elements of a safeguarding program would include:
1.  Exposure prevention procedures for maintaining a minimum safe distance
from the point of
operation;
2.  Training of operator(s) and helper(s) in the exposure prevention
procedures;
3.  Supervision to assure that the exposure prevention procedures are
being followed;
4.  Periodic inspections and annual evaluations of the exposure prevention
procedures and
program.

brake;  On or
about 1/5/11, a "safe distance" safeguarding program was not developed and
implemented for the employee(s) and helper(s) operating the press brake.
