Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, employees were operating powered industrial trucks (forklifts) without the use of seatbelts. Employees used the forklifts for load flatbed trucks and to move product within the facility. The facility Clark brand forklift was equipped with a seatbelt, however, the seatbelt was not being used. The described condition was observed on two occasions. This condition exposed employees to the hazards of being struck-by the forklift in the event of a roll/tip over accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require employees to wear seatbelts, train employees on seatbelt usage, inform employee of the hazards of not wearing seatbelts and enforce workplace rules concerning the wearing of seatbelts.
