North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The Employer did not furnish to each of his employees conditions of
employment and a place of employment
free from recognized hazards that were causing or likely to cause death or
serious
physical harm to employees,
in that employees were exposed to crushing/struck by injuries or death
while driving industrial trucks without
using/wearing installed seat belts:
a)  Establishment - Employees failed to wear the seat belt restraint
system while operating industrial
trucks in violation of employer's training program and stated directives.

Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
establish regular supervisor checks of employees to ensure seat belt use
is being complied with.
