North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the possibility of a non functional eye wash, when employees were exposed to corrosives. a)Tube Extrusion Plant: during interviews, it was ascertained that a self contained eye wash station near the battery charging area was not tested weekly to ensure that it would be functional if needed by employees. (b)Boiler Room: during interviews, it was ascertained that a plumbed eye wash was not tested weekly to ensure that it would be functional if needed by employees. c)Jacket Inspection Area: during interviews, it was ascertained that a self contained eye wash station near the battery charging area was not tested weekly to ensure that it would be functional if needed by employees. d)Shipping Department: during interviews, it was ascertained that a self contained eye wash station near the battery charging area was not tested weekly to ensure that it would be functional if needed by employees. REF: ANSI Z38.1-1990 - for Emergency Eyewash and Shower Equipment: Section 7.5.1 Eye/face wash units shall be activated weekly to flush the line and to verify proper operation. An acceptable and feasible method of abatement would be to have an employee test each eye wash station weekly to flush the water and if needed, refill the self contained eye washes.ed
