North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls from the forklift that was supporting elevated pallets without a proper cage or platform designed for that purpose. a)front wall of the facility - two employees were painting the trim of the building while each employees was being elevated over 10 feet by the use of a "TCM" solid tire straight mast forklifts without a proper secured platform or fall protection. One means of abatement would be for the employee to use a scaffold system or a ladder with an upper offset bracket to rest against the wall securely above the awning structure (Reference: Part #214AB-02701) The safety label on the curb side of the mast Warning of injury or death associated with riding the forks.
