North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to electrical hazards as referenced in the NEC, 305-6(b): a)4104 Banks Stone Drive, lot 71-a temporary power pole was observed to have a 240v outlet with an inoperable GFCI, into which a Emglo compressor was plugged into and being accessed by employees of the framing subcontractor. A feasible means of abatement is to manually check the 120v and 240v side of the temporary power pole for a functioning GFCI before plugging any equipment into the T-pole or allowing subcontractors to use the T-pole.
