North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck by falling steel storage racks and/or the components of the steel storage racks, including any materials stored on the racks: a)in the hanging storage area of the facility, where the garment racks were not load rated for the maximum weight of apparel that could be safely hung. On March 13, 2006, Hanging Storage Area F6-1 through I5-1, consisting of 35,000 square feet of metal tube racks fully loaded with hanging apparel, collapsed. On this date, it was noticed that two of the metal tube supports of this storage rack were beginning to bow out due to excess weight. A lift truck was used in an attempt to straighten these vertical supports by pushing them back into place, after which the entire rack collapsed. ABATEMENT NOTE: Among other methods, feasible and acceptable abatement methods include: 1.Have the rack system load rated by a professional engineer after it is replaced as well as the remaining standing rack system. 2.Develop a maintenance program designed to recognize weakness in the rack system to prevent a structural collapse. 3.Instruct the employees of the approved rack load enabling them to verify the maximum amount of material that can be safely stored. 4.Follow the guidelines established in the American National Standards Institute (ANSI) MH 16.2-1984,Section 1 Paragraph 1.3, which states that damaged racks shall be immediately unloaded and the damaged portions be repaired or replaced, and all other sections which apply.ns
