North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of employment
free from recognized hazards that were causing or likely to cause death or
serious
physical harm to
employees in that an employee was exposed to a fall to concrete of
approximately 18':
a)rear of facility:  the site superintendent elevated an employee of King
Roofing &
Manufacturing Corporation, not wearing any type of fall protection
equipment,
approximately 18' above the ground to attach piping to the side of the
building while
standing on a pallet that was on the forks of a Caterpillar TH305B
hi-lift. [Reference:
Safety Standard for Rough Terrain Forklift Trucks, ANSI B56.6-1992]
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to provide
a scissor lift for this type of work.
