North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of employment
free from recognized hazards that were causing or likely to cause death or
serious physical harm to
employees in that an employee was exposed to a fall to concrete of
approximately 18':
a)rear of facility:  an employee, not wearing any type of fall protection
equipment, was
observed attaching piping to the side of the building while standing on a
pallet that was on
the forks of a Caterpillar TH305B hi-lift, approximately 18' above the
ground.  (Reference:
ANSI/ASME B56.6-1992, Safety Standard for Rough Terrain Forklift Trucks,
paragraphs
5.15 and 8.25)
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to provide
a scissor lift for this type of work.
