Title 40.1-51.1(a), Code of Virginia: Employer did not furnish employment, and a place of employment which were free of recognized hazards that were causing, or likely to cause death or serious physical harm to employees in that: Employee(s) were exposed to fall hazards while performing various job related duties when employee(s) were permitted to work from a job made box lifted by the forks of a LULL 1044B forklift. The LULL 1044B forklift should not be used to elevate personnel, as it is not equipped for this purpose. One feasible, and acceptable abatement method among others to correct this hazard is to comply with the sign posted in the operators compartment, and page 15 of the operators manual, which both read: NOTICE 3. This machine is not equipped to lift personnel. Never use this machine as a work platform..

The operators manual was not present with the machine. This machine is not equipped to lift personnel. One feasible, and acceptable abatement method among others to correct this hazard is to comply with sign posted at cab entrance, side panel, and on page 14 of the operator's manual which reads: CAUTION 1. Do not operate this machine until you have read and are thoroughly familiar with the operators manual. Always keep the manual with the machine.
