Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the dumbwaiter: (a) On or about 02/14/06, employees use a dumbwaiter, located in back of a flower shop, were exposed to an amputation hazard. The cap became stuck because of overloading and came down suddenly. The inside door handle caught the employee's fingers resulting in the amputation. One feasible and acceptable method to correct this hazard, among others, include: Ensuring that the dumbwaiter meets the requirements of the American National Standard Safety Code for Elevators, Dumbwaiters, Escalators and Moving Walks, ANSI A17.1-1971, Part VII, Hand and Power Dumbwaiters, Rule 702.3 Capacity Plate: A metal plate shall be fastened in a conspicuous place in the car and shall indicate the rated load in letters and numerals not less than one quarter (1/4) inch (0.635 cm) high, stamped, etched or raised on the surface of the plate.
