Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) At the work site, an employee was being exposed to a fall hazard while standing on top of a trash compactor and washing the top surface which measured 8 feet high, 4.5 feet wide and 10 feet long. The surface was wet, slippery and the employee was not provided with fall protection. One feasible and acceptable mean of abatement is to train the employee to work from the portable stair ladder or from an aerial lift. In the alternative, 29 CFR 1910.23(c)(1): Open sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railing or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v), on all open sides.
