Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about May 17, 2006, at the Trinity Woods/Trinity Pass job site, two employees were riding in the bucket of a Bobcat while it traveled on a street, exposing them to falls from the moving equipment onto the street. One feasible and acceptable abatement method, among others, would be to follow the Equipment Manufacturers Institute (EMI) Safety Manual for operators and machanics which states, "Never use the bucket for a work platform or personnel carrier."
