Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls: (a)At the establishment where employees use a work platform secured to a forklift, which was provided with a top rail, but was lacking an intermediate rail, exposing the employees to the hazard of falls of up to 15 feet onto a concrete floor: Among other methods, one feasible and acceptable abatement method to correct this hazard is to utilize safety platform that meet the requirements of American Society of Mechanical Engineers ASME/ANSI B56.1-1969, Safety Standards for Low Lift And High Lift Trucks.ds
