Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls: (a) Access to cranes: Werner fiberglass ladder was not manufactured to meet the safety standards for fixed ladders. In accordance with ANSI Standard A 14-3 Section 9.3.1 Intended Use: "Ladder use shall be restricted to the purpose for which the ladder is designed." The ladder was also used in a vertical position not the manufacturer's requirement of a 75 degree angle. These ladders were in use on all the cranes in the potroom. CM&S, READING and NORTHERN cranes were in use. Among other abatement methods, feasible and useful, one method of abatement would be to ensure that all crane access ladders are designed and maintained in accordance with the manufacturers' specifications.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by falling material: (a) Job-made brick buckets were not prooftested, marked as to weight, load capacity, manufacturer and serial number and were not inspected by competent persons to ensure they were safe. Among other abatement methods, feasible and useful, one method of abatement would be to comply with the American Society of Mechanical Engineers standard for Below the Hook Lifting Devices (ASME B30.20-1999) Chapter 20-1 "Structural and Mechanical Lifting Devices."
